Sacred Key Fellowship Release of Liability

 

By participating in any activities associated with Sacred Key Fellowship ("the Fellowship"), I acknowledge and accept that I may be exposed to a variety of hazards and risks, both foreseen and unforeseen, which are inherent in such spiritual practices. These risks include, but are not limited to, serious personal injury, allergic or adverse reaction to plant or fungal sacraments, psychological distress, property damage, and even death ("Injuries and Damages"). These may arise from natural causes, actions of other participants, animals, or the actions or inactions of Fellowship leaders, facilitators, assistants, or third parties.

I understand that Sacred Key Fellowship incorporates the ceremonial and sacramental use of psilocybin mushrooms, and that I am responsible for exercising care and discernment in how I engage with these practices. I further acknowledge that Sacred Key Fellowship is a spiritual and religious organization and not a licensed medical provider, therapist, or mental health practitioner.

In consideration for my voluntary participation in Fellowship activities, I confirm my understanding and agreement to the following:

  1. Assumption of Risk

    • I understand that participating in Fellowship activities and consuming sacramental substances carries inherent risks. I freely and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable.

  2. Health and Safety Acknowledgment

    • I affirm that I am in good physical, mental, and emotional condition to participate in Fellowship activities. I understand that reactions to mushrooms and other sacraments can vary and may result in unexpected psychological or physiological responses.

  3. Waiver of Liability

    • TO THE FULLEST EXTENT PERMITTED BY LAW, I AGREE TO RELEASE AND DISCHARGE Sacred Key Fellowship, its founders, directors, employees, facilitators, agents, volunteers, landowners, and all associated persons and entities (collectively, “Released Parties”) from any and all liability, claims, demands, or causes of action that may arise from or be related to my participation in any Fellowship activity.

  4. Indemnification

    • I agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties from any claim, lawsuit, damage, loss, or expense (including attorney’s fees) brought by me or any third party related to my participation in Fellowship activities or use of sacrament.

  5. Understanding of Legal Implications

    • I acknowledge that this release is binding upon myself, my heirs, assigns, personal representatives, and all others who may claim through me. I agree that this release shall apply indefinitely and shall remain valid for any and all future participation with the Fellowship.

  6. Legal Jurisdiction

    • I agree that any legal action brought in relation to this agreement or to my participation in Fellowship activities will be filed in a court of competent jurisdiction in the State of Colorado and governed by the laws of Colorado.

  7. Severability

    • If any provision or portion of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  8. Consent for Participation and Agreement

    • I agree that submission of my membership application or digital acknowledgment shall constitute my full acceptance of this Liability Release. I consent for myself and any dependents or minors in my care.
